TERMS AND CONDITIONS OF SALE.
Please read this document! It contains very important information about your rights and obilgations, as well as limitaions and exclusions that may apply to you.
These terms and conditions ("Agreement") apply to your purchase of any of our in car entertainment systems and/or related ADS products, goods, items or product or products as displayed on the ADS shop web site or as descrribed in an email we may have sent to you if a new product is not online at the time of purchase; sold in the United Kingdom ("Product"). By accepting delivery of the Product, you accept and are bound to the terms and conditions of this Agreement. If you do not wish to be bound by this Agreement, you must notify ADS Shop, in writing stating you do not wish to be bound by these terms and conditions, within twenty four hours of accepting delivery and return your purchase / product / goods pursuant to ADS Return Policy. Product or products must NOT have been installed or tampered with during the twenty four hour period, you need acknowledgement we have recieved your request via an email.
Photographs on our Web site are provided to assist you in identifying the pieces you require. We endevour to ensure that the digital representations are as accurate as possible, but please be aware that some variation may exist between the colour displayed on your monitor and the actual colour of the item in question.
The contract is created upon placing an order from our site. All contracts to supply are made under Scottish, British and European law.
The receipt by you of an order confirmation does not constitute acceptance of an order. Prior to our acceptance of an order, we may need to verify relevant information. We reserve the right at any time after receipt of your order to accept or decline your order, or any portion thereof, even after your receipt of an order confirmation, for any reason. We also reserve the right to limit the order quantity on any item and to refuse service to any customer without prior notification.
We pride ourselves in the service we provide, however, we are human and it is possible that errors exist in our online database. Quotations given are in good faith but are subject to availability. If we are unable to supply goods for which we have received payment, will will inform you of this and provide you with a full and prompt refund.
In the event that goods are advertised at an incorrect price, we reserve the right to refuse or cancel orders, regardless of whether you have recived an order confirmation email, and whether your payment has been received. In such an event we shall of course provide you with full and prompt refund. Six months warranty is on the condition the installation is made by our appointed installation company, otherwise we do not give any warranty on the models/products if installation is carried out by any other person/s or installation company.
On our Web site, all prices are in Pounds Sterling. Your credit card company will convert our Pounds Sterling charge into your home currency on your credit card statement. This price may vary slightly from the advertised Euro price due to exchange rate fluctuations. Our exchange rates are updated daily to minimise such variations. Therefore, all prices quoted in currencies other than Pounds Sterling are subject to confirmation.
Full payment is required prior to dispatch. We accept the most Credit/Debit, however we may take a few days to complete security checks on the card used. Alternatively we accept payment via PayPal or cheques drawn on a U.K. bank. Cheques must be made payable to ADS Shop.
For orders paid for by PayPal or by UK cheque, if payment is not received within one calendar month the order will be cancelled.
Orders are usually shipped within 1 - 21 working days of our receiving payment. All goods will be delivered within the statutory performance period of 30 days (from the date of payment). If this is to be later we will notify you.
It is the customer's responsibility to ensure that their supplied address details are correct at time of purchase, as we cannot be held responsible for incorrect or non-delivery due to customer error.
All packages are safely wrapped with appropriate packing materials. In the unlikely event of breakages in shipping, please notify us within 48 hours. We will supply replacements free of charge, however you are responsible for sending the item back to us and the costs.
Please note colours may vairy slightly on different computers, if there is any doubt on colour please ask for a swatch to be sent prior to order.
You may cancel your order prior to shipment, (Working days exclude weekends and public holidays). Notification of cancellation must be in written form (by letter or email), notification by telephone or fax is not sufficient. (This is in accordance with the Distance Selling Regulations 2000). Notification of cancellation may be sent via email to info@ads-shop.com, or by post. You must have notified us and received a returns number from us within the seven days, only recorded delivery letters delayed after the 7 day period will be considered for a refund or credit note, any items returned without a number will not be refunded and sent back.
Custom orders, special panel units that is the Factory Fit Selection, and any 'built in' features such as Sat Navs / GPS sytems, and special parts, and beige headrests, and car special make headrests, that is say, bought in for a customers BMW for perfect colour match, are under the 'custom order' trading law therefore no refund is available
If you choose to cancel your order, the goods must be returned to the returns address which you need to obtain in writing within seven days of delivery of the product/s, any products sent to the London address will be returned at your own costs, WE DONOT ACCEPT RETURNS TO THE LONDON ADDRESS. Returned goods must be suitably packed to help ensure their safe return - we request that the original packing materials are used for this purpose. An adminsitration charge of £50.00 will be charged on accepting returned items, (according to our returns policy). Where goods are returned for reasons other than loss, damage, or error on our part, you are liable for the return shipping costs and testing costs the product is still in perfect working order. We ask that the goods are returned within 7 days. If you fail to return the goods, we reserve the right to charge for the cost of collecting the goods, or you will be invoiced for the full fee of the goods. You are legally obliged to make them freely available for collection.
When an order is cancelled according to the procedure written here, an administration fee of £30.00 will be charged and deducted from the refund. A refund will be made usually within 3 - 5 days, certainly within 30 days, as is required by law, excluding any charges already noted here. Delays may arise on refunds if the proceedure requested here is not followed. Refund will be made via the same medium as was used for payment (e.g. cheque or credit card).
We will do our best to help you and correct any matters you are not happy with. Plesae do help us to deal with your returns by the following process. Thank you very much.
We guarantee that our products are up to your satisfaction and offers six months warranty for all products it sells from the date of dispatch, on the condition the model is fitted by one of the appointed National Installation Service Team. If a customer chooses to fit the model / product to the car / vehicle or has a different company than The Appointed Installation Team / Company, the six months warranty is void. Faulty wiring can render the model faulty, therefore incorrect installation can damage the product.
The warranty is offered on the product/s only (hardware) and to direct customers only there is no warranty on labour as ADS Shop does not provide labour or fitting, ADS Shop acts as a booking agency only for approved fitters, National Installation Team / Company. All fitting or installation fees and agreements are between yourself and the fitting company that performed the installation. All customers must obtain an RMA number from the manufacturer prior to any return, replacement, and repair, and they MUST have sent in their warranty card with seven days of receipt of delivery of the product.
Satisfaction Guarantee: For any product that is not to your expectation upon receipt, please contact ADS within 7 working days of receipt. We will find a satisfactory resolution based on return, replacement, or credit. However the product MUST come back in perfect condition, that is not scratched, damaged, dirty or with parts missing, or paperwork missing such as the manuals and the box it was dispatched in, otherwise the goods will be photographed and returned without a refund / credit or exchange, this may take up to 90 days if an item is found to be damaged or faulty on its return.
All or any, Free gifts, promotional gifts, sale items, and / or discounted items may not be exhanged in discount, or given credit for. Therefore, if a free gift is late, or lost, or damaged, or faulty, ADS will not refund the regular price off the buyers invoice. For example, if we gave a free car camera at 49.99 we will not refund 49.99 at a later date back to the buyer.
Damaged or missing product or products: If any package is visibly damaged upon delivery by the courier. Please accept the package and make a note made on the carrier delivery record. Please notify ADS immediately so that a claim can be filed with the courier. Please hold the merchandise and the original packaging for the courier's inspection and investigation. Failure to take the above actions may risk the receipt of proper compensation. Damaged or missing product or products are subject to insurance up to the customs invoice value. We have the right to inspect it and will offer a replacement only, if proven the damage was done in transit. If we feel the damage was done once in the buyers possession we may not offer a refund or replacement, and claim costs for the our investigation time, all items carry a bar code for identification.
It is ADS Shop right to test and inspect any items a customer reports as being faulty or damaged.
Once an item has been shipped out, if a customer changes his mind, or there are delays in the customer collecting the item for any reason whatsoever, and decides to cancel the order, the fee for returned item still applys, at £40.00 per item dispatched.
Warranty Limitations: The Warranty does not cover any Labour / Installation fees, all agreements on labour are independant to ADS Shop, and the models / item / product / products. ADS ONLY sells and supplies In Car Entertainment Products or product. The warranty does not cover driver incompatibility, normal wear, damage due to accidents, physical force, water, fire, power surge, act of God, and other mis-uses, and incorrect fitting, six month warranty is only with goods installed by the appointed fitters. Please also keep your invoice when the appointed installation team, (fitters) fits the product or products to your car / vehicle. There is no labour warranty from ADS we ONLY supply the ('hardware') product.
The guarantee is that the product or products supplied to the Customer will be free from defects caused by faulty materials or poor workmanship for a period of six months. Under this warranty the manufacturer will, at its option, either repair or give a replacement of equivalent quality or issue credit note to the Customer for any product or products found to be defective because of faulty maintenance by the manufacturer or poor workmanship provided that:
i) the company is notified in writing within 7 days of delivery if there are any such defects, and the invoice, from the appointed fitters / installation team, related to the fitting of the product or products in question must be submitted in writing by regular mail with the complaint. All complaints MUST be dealt with in writing ONLY. And the Invoice from the Appointed fitters MUST be included with any Complaints. Any complaints regarding the product we have supplied MUST have the invoice from our appointed fitting / installation team, included in the letter, or we cannot deal with your complaint.
ii) The product or products have been used in an appropriate manner and/or as prescribed in the operating instructions (if any), and have been installed by the appointed installation company. And/or have not been damaged by misuse/water/fire/overvoltages.
iii) The defective Goods are returned to ADS Shop at the Customers expense.
iv) Examination by the Manufacturer of such product or products discloses its satisfaction that such defects exist and have not been caused by misuse, neglect, accident, improper storage installation or handling or by repair or alteration or faulty installation not effected.
v) The Product or products not having been modified or repaired already by a third party or the customer otherwise interfered with and
vi) The Customer shall pay to ADS Shop the cost (as certified by ADS Shop) of any examination of such products as a result of which the Supplier denies liability.
Vii) If ADS Shop has agreed the item was faulty prior to installation, ADS Shop will either repair or send a replacement for the item in question ONLY. The item / product that is in question for repair or replacement, is required to be uninstalled and returned to ADS Shop with the RMA number as already noted here and according to our returns policy. Once the repaired or replaced item has been delivered and accepted by the customer, that is accepted in full and final settlement. A third item will not be sent or repaired in replacement, via ADS Shops' United Kingdom repair center, however you may request a RMA number and any third item may be sent overseas for repair at the customers own costs and risk to ADS Shops appointed repair unit, and as noted no fitting fees can be refunded. The customer will have to request an RMA number and address details for shipping overseas via info@ads-shop.com. If a customer requires a fitter to return, a minimum charge of £40.00 will incur, which is too be negociated between the customer and the fitter / installation company, we at ADS Shop will provide you / the customer with contacts for the Appointed Installation Team/s or fitter/s.
Viii) There has been damage caused by an infant kicking the monitors, (usually headrests) in the back of the car. Please note, car baby chairs often are in line with the monitor screen and this may lead to damages by your child accidentally kicking it. We will inspect the item however if we find it has been kicked by accident there is no warranty.
Viiii)All fees must be paid to the fitter / installation company / and ADS Shop, if any fees are not paid we can not inspect any goods with the view to repair
If an item has been fitted to an import vehicle and the fitter advises there may be different wiring to normal wiring and so part of the item does not function, (usually the radio) we are not accepting liability and the item may not be exchanged or refunded.
If you buy goods which have no published technical specifications, it is your responsibility to establish the suitability of the goods for your intended purpose.
Return of Equipment Goods / product or products policy.
Any returned items declared faulty, are required to have their reciept sent for proof of purchase and the reciept for installation
Return of Equipment Goods / product or products will not be accepted by the manufacturer until a Return Material Authorisation (RMA) number is obtained and the Goods have been returned to ADS Shop at the customers expense. All products or product must be returned in perfect condition, that is in the same condition it was sent out, dirty, broken, damaged or missing parts and paperwork / manuals, the product or products shall be retunred back to the customer and no refund or exchange will be given. Products or product must NOT have been installed for a refund. Any material including the official boxes or manuals that are not returned in their original condition they were sent out in: this will incur a charge according to ADS Shop, and as already noted on top of this fee, our administration fee of £30.00 per item returned will be charged. For example, if a customer opens a product, looks at it and decides they dont want it, our administration charge of £30.00 will be deducted from the refund, on the condition the returned goods are in perfect condition and working order.
If a customer cancels after purchasing but the item has been dispatched, it is the customers responsibility to ensure safe return of the item. If the item is left at the sorting office there will be double the fee charged to the customer, on having the item sent back to us, as this is the fee we at ADS shop are charged, therefore the customer will be required to pay these costs.
If a customer decides he is moving house suddenly after purchase, and notifys us in writing this is the reason he requests to cancel his/her order, but the item has been dispatched already, we will not refund whatsoever if the customer does not collect and return the item safely to us in accordance to our returns policy. Any costs we uncur will be charged to the customer.
If any items returned which are found to be damaged by the customer no fee will be refunded, and an additional fee of £40.00 will be charged for return BACK to customer the item and additional costs for repairing the item for use and / or assesment fees which may include the item being sent back overseas to ADS Shops appointed assesment / repair unit, this may take up to 120days before a decision is final.
If the terms and conditions here noted are broken, eg, a buyer / customer / end user has fitted the model him or herself or not used the appointed professional installation team/s / or company / or fitter/s, you may return the product or products direct to the overseas repair unit for assesment with the view to having the item repaired; if we at ADS Shop approves the request, and / or if we at ADS Shop agrees for it to be assessed with the view to being repaired. You need a RMA number before you return it. We at ADS Shop have no liablity if you chose to return direct to the appointed repair unit oversea, shipping and all risk is at the buyers / customers costs.
If a customer decides the item is 'not as described' we need to be notified within seven days from delivery, in writing to info@ads-shop.com. Any 'not as described' claims after seven days are not accepted.
Customers must obtain an RMA number from ADS prior to returning any merchandise back to ADS Shop, or the returned items will not be processed. RMA numbers can be requested by communicating with our customer service support team, via email at info@ads-shop.com with the details of damages or defects. Merchandise returned without an RMA number will not be processed and sent back to the customer with an invoice for ADS return costs. The RMA numbers are valid from 7 days after being issued. After you get an RMA number, please send the item(s) immediately back to the address requested in your email sent with your RMA. The Customer is responsible for proper packaging of all returns and costs. All warranties will be void on items that are insufficiently or inaccurately packaged. For your protection, please insure the returned package(s), provide, 1. Tracking reference, 2. Proof of Posting, and 3. Have the item/s Insured. Items that dont reach the manufacturer, designated address, we at ADS SHOP can not refund any fees for lost goods or damaged in transit. If we have sent a replacement, the customer is responsbile for the safe return of the original items, or items which have been replaced otherwise and invoice will be sent for the replaced products, tracking, proof and posting and insurance applies for ANY returned item. Also a copy of your invoice for fitting from the appointed installation team must be included. If you do not provide the fitting invoice, issued from the appointed Installation Service, we can not accept returned items.
Any Items returned due to change of mind with the customer, (within the seven day period after delivery) over the colour of headrests will still be charged £40.00 for administration costs. All parcels / goods / products MUST be checked before a fitter or appointed installation team arrives as parcels / goods / product/s only checked on the day, and the customer wishes to exchange the goods/ or products or there is an item missing, a £40.00 call out charge will be charged, or the booking fee will be used, (not refunded) for the fitter or installation teams time, any 2nd bookings for installation is in agreement between the fitter and customer. If a fitter and customer are not in agreement for a second booking for a fitter we at ADS Shop are not responsible for any agreements between customer and fitter or installation team/s. It is ADS Shop decision to asses the situation and decide if a second fitters details maybe sent to the customer for installation of the products in question. If a customer STILL has the products fitted and then they are not happy with, eg, a colour issue, or a matter that could have been resolved without the product being fitted, or if an item is missing and this has not been checked prior to the fitter arriving, all costs will be with the customer and a call out charge will be charged if the fitter has arrived, or it is the day of the fitting. ADS is not liable for any fitting costs or labour costs. All items must be returned under the already noted terms and conditions here.
Please be aware that we will not refund the carriage paid on the original order, or the cost of returning the items to us. Goods must be returned in the manufacturers original packaging together with any additional enclosures, such as Manuals, free software etc. You must ensure that adequate packaging is used to return the goods. We reserve the right to reject any item(s) returned that do meet the criteria laid out in our returns policy.
A restocking fee of up to 25% of the original invoice value may be levied on item(s) accpeted for a returned.
GPS - SAT NAVS, the items that come with a SD Map Card; the SD MAP can be easily copied, therefore if a customer admits to putting the SD card into a personal computer, this is considered as tampering with the item / SD Card. Therefore if the customer then wishes to return a SAT NAV / GPS system item, the SD MAP is non refundable, there will be a charge for this at £40.00 which will be retained from any refund, (the SD card may be kept by the customer).
Any items sent a second time or hand delivered by a fitter for urgent requests, the customer is liable for the costs of both products, if the original has been dispatched, or we are sending a replacement due to a fitting or fault issue, until one of the items are returned via the returns policy as described here.
INSTALLATION: Please note when making a request for booking it will be via 'Atlanta' this is a bookings agency for the fitters / installation company. Please note, all installations / or bookings with fitters the agreement is between the customer and the fitter / Installation company on any work performed on the customers vehicle / car. Atlanta via ADS Shop acts as booking agents for the fitters / Installation teams / company only, we are not liable for any warranty on fitting. After the fitter has left the location where the fitting took place, if there are any future problems with the product / installation or fit, a call out charge may apply. If a customer needs a fitter to return back to a fitting a second time, this is to be negociated between the customer and the fitter.
If a fitter arrives and the customer who booked the fitting is not in, or for whatever reason the fitting does not take place, and we at ADS Shop or Atlanta has not had 48 hours notice, the full fee of the installation will be charged. It will then be up to the customer to liase with the fitter to fit the job at a later date for an additional fee, no second bookings can be accepted until the first payment is paid in full. We at Atlanta via ADS Shop will not refund any booking fees if a customer has not kept the appointment for the fitter and the fitter arrives, or if a fitting is cancelled after 24 hour notice, and the work is not taken place. If a customer adds items on the day which have not been listed or agreed upon either verbally or in the booking email confirmation and the fit is not performed, the booking fee will not be refunded.
All agreement are on fitting / installation are bewteen the customer and the fitter, in the exeption of non payment to the fitter on the day. Therefore, if a fitter begins work on a customers vehicle and a dispute arises, and the customer refuses to pay the fitter the agreed discounted fee, we at Atlanta may pay the fitter his fees on the customers behalf and look to recover our costs from the customer. The customer will have seven days to pay the fee in full. If the customer fails to pay the fee in the seven days, we will cancel any discount with the customer, and look to cover the full fee of the fitting, including £25.00 administration charge and each letter and / or email maybe subject an additional adminstration charge.>
HEADREST COLOURS, and headrest function. It is soley the customers responsibility to check the colour of the headrests and the headrests are suitable for the existing interior of the vehicle, and the headrests have the visable functions as described at the point of sale. Once headrests have been installed, if a customer has an issue with the colour, or the products functions, having the product taken back out, (uninstalled) will be at the customers expense. Advise is sent in every booking / installation email requesting the customer checks and is happy with the colour of the headrests and the product visable functions, (eg sd card and usb port viable) purchased PRIOR to installation. We are NOT responsible or liable for any mistakes on colour of headrests, or product function missing, (eg sd card or usb port) once the headrests have been fitted or installed into the / a vehicle. Any problem that can be corrected before fitting is at the customers costs to have the problem resolved. If a customer fails to check the colour of the headrest, or any product fuction which is visable without installation required, and the product is installed, all costs of rectifying the matter is at the customers expense. Once headrests are installed they are classed as used and ADS Shop is not in a position to accept returns on used items due to colour problems, or visable functions missing, (EG sd card and usb ports). All fitting fees need to be paid to the fitter, or installation company if the headrests are fitted and the customer does not like the colour. If a customer wishes to change the colour of any headrests once fitted, or installed, the customer will have to purchase at full price the colour required, and pay the fitter the fitting fees for the headrests to be changed. We will not accept headrests back once installed under any circumstances whatsoever due to customers colour issues or any matter that can be rectified before installation. If a customer complains about the colour of headrests he has fitted or installed by the appointed installation company, or fitter, and we refuse to change them at our costs, then the customer complains at a later date the headrests have broken or are faulty, we will not refund or exchange the headrests, all warranty on the installed headrests is void.
Any problem related to any product which can be rectified before installation, ADS Shop accepts no liablity in costs for installation or any costs incured due to the customer 'changing his mind' about a product after installation and / or during installation. Atlanta reserves the right to collect any unpaid installation fees from the customer that may have been paid to the fitter, on the customers behalf.
We can confirm if you car is a 'singel din, double din, or din and a half. We are not responsible for any issues such as dashboard dials, buttons, digital information, gear stick, clocks, over hanging parts, air vents or any part of the vehicle which may hinder the seven inch single din motorized screens movements; as these issues can be identified with the correct research, and viewing our online images prior to installation. Please email in any images of your dashboard in advance if you are concerned of any parts which may cause you concern for written confirmation from us.
CORRECT RETURNS & INSURANCE.
CUSTOME MADE / SPECIAL PANEL ORDERS and Car PC's (car computers) All sales are final on these CUSTOME MADE / Special Panel products as they are made to order by the customer,therefore they are 'custom made orders', delivery can take from 7 - 45 days on these special custom made orders and special Car PC / Car Computers. Any issues or complaints on a custom made orders a customer MUST notify us within seven days after delivery. Only if the product is considered faulty and professional fitting or installaion by one of the Appointed Installation Team has taken place will we consider a return and repair only, (no refunds or exchanges) under terms and conditions stated here. All other Terms and Conditions apply regarding the custom order / special panel products and car pc / car computers.
Please note there is a testing fee of £40.00 if an item is returned as we have to test to make sure its not been damaged or used by the customer, this is in addition to the other fees noted for a returned item,
Please note to return the item, it must be insured, it is the senders resposibility to make sure it is insured and reaches the destination safely. It must be sent recorded delivery or signed for, or have a form of tracking / delivery proof. We keep which option open for the best price when you take it to the post office. Please ask the post office for advice on sending at the best price with insurance. All returned items postage needs to be paid by the sender.
PARTS ORDERED, any parts ordered, such as fascia, leads, iso leads, ariel adaptors, are non refundable.
CUSTOM ORDERS: Custom orders are made to order such as special panel products, and / or orders where the customer requests 'features to be built in' many items have a basic features, and extra features are needed to be built in, therefore this is classes as a CUSTOM ORDER, under trading law custom orders are not available to be cancelled once paid for. Therefore no custom orders are availble for cancellation after payment
Any items returned and refunded will be charged the shipping fee as most items cost more than £9.99 to ship, and administration fee totallying £40.00, on the agreement that no fitting to a / the vehicle has take place otherwise the item will be returned to the customer and no fees refunded.
Broken glass or monitors will not be refunded or exchanged as there is no insurance to cover this neither do any postal services accept liability on broken monitors screens, such as a crack in the screen, or glass items.
Any items returned and found the model / goods / products or product is in full working order a fee according to our cost incured will be charged to the customer, the customer will need to pay for the goods to be returned. This is due to items beng poorly fitted by non professionals, and it is poor installation of the product that makes an item appear faulty.
For the appointed installation team, call 0870 220 3221 ADS Shop ONLY arranges the DATE AND TIME OF THE INSTALLATION, with the appointed fitters / installation team/s, the fitters and / or installation teams are NOT on our payroll, they are INDEPENDANT companies, therefore any agreements on fitting, labour and any fitting fees go directly to the appointed fitter / installation team. We need a booking fee to secure the date which is betweem £20 to £100. ADS Shop acts as booking agents for the appointed fitters, installation team/s only.
By using our site and / or making a purchase from the ADS Shop web site, and / or by making a purchase / transaction over the telephone, you agree to our terms and conditions. As written and the start of these terms and conditions, By accepting delivery of the Product and, or products, you accept and are bound to the terms and conditions of this Agreement. If you do not wish to be bound by this Agreement, you must notify ADS Shop in writing within twenty four hours of accepting delivery, and return your purchase pursuant to ADS Shop under the ADS Shops' Returns Policy, no product or products are permitted to be installed in a vehicle or tampered with.
It is ADS Shops decision to make any changes which may help to a faster resolution for the customer, to these term and conditions, eg, ADS Shop agrees to send out a replacement before the reported faulty item is inspected, all other terms and conditions will still apply. If ADS Shop makes a 'good will offer / or any offer', then a dispute arises and communication breaks down, ADS Shop reserves the right to withdraw any 'good will offer or offer.'

Agressions will not be tolerated from any customers whatsoever, any customers who call and use an agressive tone too our sales team or talk over our support line when we are trying to help, the telephone will be put down and the customer will have to deal with your problem via email, we have the right to terminate any future comunications once the product has arrived and been signed for.
